Visas
Millions of foreign visitors travel to the U.S. each year. Others come to live here permanently. International visitors and immigrants add greatly to our nation's cultural, education and economic life.
A citizen of a foreign country, wishing to enter the U.S., generally must first obtain a visa, either a nonimmigrant visa for temporary stay, or an immigrant visa for permanent residence. The type of visa you must have is defined by immigration law, and relates to the purpose of your travel.
The Immigration and Nationality Act
The Immigration and Nationality Act as amended over the years, provides the basic framework for regulating the flow of visitors, workers and immigrants to the United States. The last major overhaul of the immigration system was the Immigration Act of 1990. This Act provides most of the still-current immigrant and nonimmigrant classification and numerical ceilings (subsequent legislation has added new classifications and/or amended existing ones -- but the basic framework remains largely the same as in 1990).
What types of visas are available for people to come to the United States?
There are more than 20 nonimmigrant visa types for people traveling to the United States temporarily. There are many more types of immigrant visas for those coming to live permanently in the U.S. The type of Visa you need is determined by the purpose of your intended travel.
Temporary Visitors to the U.S.
International visitors add greatly to our nation's cultural, education and economic life. We continue the proud tradition of welcoming visitors to the United States, with secure borders and open doors.
Most Canadian citizens and many citizens from Visa Waiver Program countries can come to the U.S. without a visa if they meet certain requirements.
Nonimmigrant visas are for international travelers, (citizens of other countries), coming to the U.S. temporarily. This visa allows you to travel to a U.S. port-of-entry (airport, for example) and request permission of the Department of Homeland Security immigration inspector to enter the U.S. A visa does not guarantee entry into the United States.
International travelers come to the U.S. for a wide variety of reasons, including tourism, business, medical treatment and certain types of temporary work. The type of visa needed is defined by immigration law, and relates to the purpose of your travel.
